The Hot Seat: What to Expect During Litigation

Course description

In this interactive session, SEMPIC policyholders are invited to join defense attorneys Cullen McKinney, Marisa Cicotte and Kurt Parker for an in-depth look at the defendant’s role in a medical malpractice lawsuit. Using a factual pattern from an actual case, attendees will get a preview of what it’s like to be interrogated by a plaintiff attorney, as well as some of the legal objections defense attorneys may make on the witness’s behalf. McKinney, Cicotte and Parker will then dissect the mock deposition, providing tips on how to answer questions and present oneself as a witness.

Attendees will walk away from the SEMPIC annual live education day with a thorough understanding of a medical malpractice lawsuit and strategies for minimizing their potential medical professional liability in the future.

Cullen B. McKinney was admitted to the bar in 1994 (State of Michigan and the United States District Court for the Eastern District of Michigan). He attended Michigan State University (BA, with distinction, 1991) and the University of Detroit Mercy School of Law (JD, 1993). While in law school, he was a member of the Law Review, where he served as a Case and Comment Editor, and he was on the Moot Court Board of Directors. He was also an Intern to former Michigan Supreme Court Justice Patricia Boyle.

McKinney is the author of "Home Office Deductions and I.R.C. Section 280A: Did Commissioner v. Soliman Really Clear Up the Meaning of 'Principal Place of Business’?" 71 U. Det. Mercy L. Rev. 155 (1993) and The Monthly Digest of Tax Articles, April 1995 (addressing professionals' rights to use their home offices as tax deductions).

He is a member of the Detroit Metropolitan Bar Association and the State Bar of Michigan (Member, Negligence Law Section). He has successfully tried numerous cases in Lenawee County, Wayne County and Oakland County Circuit Courts. His practice focuses upon multiple areas of civil defense litigation, including all forms of professional negligence, general negligence, premises liability, product liability and automobile negligence.

Marisa Cicotte is a Michigan native, and was admitted to the State Bar of Michigan in 2009. She has focused her practice on civil defense litigation, concentrating on all types of medical malpractice claims, including professional negligence, general negligence, premises liability and professional licensing defense. In 2006, she graduated from the University of Michigan with a BA in Psychology, and obtained her Juris Doctor from Wayne State University Law School in 2009. Ms. Cicotte is also certified by SCAO as a general civil mediator.

In addition to being a member of the Negligence Section of the State Bar of Michigan, she is an active member of the Michigan Society of Healthcare Risk Management, where she serves on the Education Committee. She is also active in the community in volunteering for several Metro Detroit-based non-profit organizations.

Kurt J. Parker was born in Jackson, Michigan. He was admitted to the State Bar of Michigan in 2016. He graduated from Central Michigan University with a BS in Business Administration in 2012, and he obtained his Juris Doctor from the University of Detroit Mercy School of Law in 2016. While in law school, he was a law clerk for McKeen & Associates, PC, and served as a Student Attorney for the Immigration Law Clinic at the University of Detroit Mercy School of Law.

His practice focuses on multiple areas of civil defense litigation, including professional negligence (medical and dental), general negligence, premises liability, and product liability. He has also represents the estates of decedents in the probate process, and assists clients with forming business entities. He is a member of the Michigan Society of Healthcare Risk Management.
