Join us for the 2023 SEMPIC Live Education Day as seasoned presenters Diane Birnbaumer, MD, and Cullen McKinney, Esq, share the clinical and legal sides of diagnostic error, and provide strategies to help mitigate your risk.

Session 1: A Wolf in Sheep's Clothing: Serious Conditions Behind Benign Chief Complaints
Back pain, joint pain, a sore throat – most of the time these common complaints are a symptom of something benign and usually self-limited, but occasionally they may be the manifestation of a life-threatening disorder. Using a case-based format, this lecture covers several common chief complaints that may or may not be due to a serious cause, and outlines an approach to evaluating these cases.
Session 1 learning objectives:
- Discuss the “SPIT” approach to evaluating a chief complaint
- Explain the differential diagnosis of complaints like headache, joint pain and sore throat to include possible serious conditions
- Discuss how to identify which patients may need further evaluation
Session 2: The Tribulations of a Medical Professional Liability Trial
Session 2 description: In this presentation, attorney Cullen B. McKinney will use actual case examples to demonstrate the importance of solid clinical, decision-making and risk management strategies in mounting a successful defense – and in some instances, avoiding allegations of malpractice altogether.
Session 2 learning objectives:
- Identify how medical professional liability (MPL) trials begin
- Describe how to prepare for an MPL trial once it is initiated
- Summarize how to ensure preparation for an MPL trial once it arrives
Diane Birnbaumer, MD, is residency trained in both internal medicine and emergency medicine and is Emeritus Professor of Medicine at the David Geffen School of Medicine at UCLA. Currently a Senior Clinical Educator in the Department of Emergency Medicine at Harbor-UCLA Medical Center, Dr. Birnbaumer was Associate Program Director there for nearly 20 years. Dr. Birnbaumer has presented over 2,000 lectures locally, nationally and internationally on clinical and educational topics, ranging from emergency medicine to teaching the teachers. She has received several national awards, including the Outstanding Speaker of the Year and the Outstanding Contribution to Education Awards for the American College of Emergency Physicians.
Cullen B. McKinney, Esq., was admitted to the bar in 1994 (State of Michigan and the United States District Court for the Eastern District of Michigan). He attended Michigan State University (BA, with distinction, 1991) and the University of Detroit Mercy School of Law (JD, 1993). While in law school, he was a member of the Law Review, where he served as a Case and Comment Editor, and he was on the Moot Court Board of Directors. He was also an Intern to former Michigan Supreme Court Justice Patricia Boyle.
McKinney is the author of "Home Office Deductions and I.R.C. Section 280A: Did Commissioner v. Soliman Really Clear Up the Meaning of 'Principal Place of Business’?" 71 U. Det. Mercy L. Rev. 155 (1993) and The Monthly Digest of Tax Articles, April 1995 (addressing professionals' rights to use their home offices as tax deductions).
He is a member of the Detroit Metropolitan Bar Association and the State Bar of Michigan (Member, Negligence Law Section). He has successfully tried numerous cases in Lenawee County, Wayne County and Oakland County Circuit Courts. His practice focuses upon multiple areas of civil defense litigation, including all forms of professional negligence, general negligence, premises liability, product liability and automobile negligence.
