Course description
This hour-long program, presented by attorneys William J. Cadigan and Kenneth J. Vanko, will provide participants with an understanding of the legal and business concepts that apply to the use of restrictive covenants/non-compete clauses in physician employment and practice ownership agreements. Participants will also be provided with an overview of recent developments in professional society policies related to the use of restrictive covenants, as well as federal policy concerns about how restrictive covenants might affect access to care. The webinar will provide insights into how physicians, practice leaders and their legal counsel approach the drafting of commonly used terms and provisions in restrictive covenants.
Finally, participants will gain an understanding of legal strategies, tactics and business considerations when physicians and practice organizations contemplate litigation and alternative dispute resolution over the enforcement of restrictive covenants.
Learning Objectives
At the conclusion of this learning activity, participants will be able to:
- Identify common terms and provisions in restrictive covenants
- Describe policy considerations driving the development of physician employment contract and practice ownership agreement law, particularly restrictive covenant/non-compete clause law.
- Identify options available to physicians and practice management when disputes arise over the enforcement of restrictive covenants.
